If you received a telephone call from Capital One between July 13, 2006 and March 31, 2012 while you were in California, Florida, Maryland, Nevada or New Hampshire, and were not provided with notice that the call may be recorded or monitored,
your rights could be affected by a class action settlement and you may be eligible for compensation
. A settlement has been proposed in a lawsuit called
Stanley Nader, on behalf of himself and all others similarly situated v. Capital One Bank (USA), N.A.,
Case No. CV-12-01265-DSF (RZx), which is pending in the United States District Court for the Central District of California (the “Settlement”). This is the official website of the Settlement. It contains information that explains the Settlement, the underlying lawsuit, your legal rights, what benefits are available, who may be eligible for those benefits, and how to get them.
On November 17, 2014, the United States District Court for the Central District of California granted Final Approval of the Nader v. Capital One Bank (USA), N.A. Settlement. You may read the Court’s order

The Settlement Administrator will no longer accept online claim submissions and will not accept paper Claim Forms postmarked after this date (other than Claim Forms that are re-submitted during the 30 days after being deemed deficient by the Settlement Administrator).
Who is Included?
You are a Class Member if during the period between July 13, 2006 and March 31, 2012, you were in California, Florida, Maryland, Nevada, or New Hampshire, received one or more telephone calls from and spoke with a representative of Capital One Bank (U.S.A.), N.A. (“Capital One”), and were not provided with notice that the call may be monitored or recorded.
